The following is a brief case analysis of the case titled Shri Bodhisattwa Gautam v. Miss Subhra Chakraborty [(1996) 1 SCC 490]. This case is a landmark judgement by the Supreme Court which lay down the jurisdiction of the Supreme Court under Article 32 of the Constitution of India to award compensation for violation of Fundamental Rights, especially interim compensation to rape victims. Another characteristic ingredient of this judgement is the holding of rape as a violation of Fundamental Right to Life and personal dignity guaranteed under Article 21 of the Constitution.
