The law enforcement agencies act as the protectors of the human rights of its citizens. However, at times these officials outlaw the very rights that are made for the protection of its citizens. The transgression of human rights by the Police upon its citizens is most often observed when an arrested person is taken under police custody for interrogation.This paper focuses on the legal and constitutional rights of an arrested person in police or judicial custody, the instances of custodial violence during interrogation, the techniques of interrogation used by the police, landmark judgments surrounding the preservation of human rights during interrogation and the international commitment towards protection of human rights.It also highlights the need for legal assistance at all times during interrogation to prevent any violation of human rights.
